POSITION MISSION: The Litigation Specialist is responsible for handling multi-line claims in litigation or that present a significant claim exposure. Primary responsibilities include working directly with defense counsel, providing technical support to the casualty units, researching legal topics, and assisting in ensuring that litigation management quality controls are maintained.  

POSITION ESSENTIAL FUNCTIONS AND RESPONSIBILITIES:

  • Review all new lawsuits and provide recommendations for handling
  • Evaluate complex coverage and significant loss exposures 
  • Compliance with Claims Service Guidelines and Unfair Claims Practices Laws and Procedures in each state
  • Maintain records of suits and final dispositions
  • Monitor defense counsel adherence to litigation procedures, including prompt budget submissions
  • Assist in conducting defense counsel audits
  • Ensure that proper reserving, strategy, and settlement techniques are being used
  • Attend depositions, settlement conferences and trials when necessary
  • Represent company in Declaratory Judgment Actions when appropriate
  • Utilize Alternative Dispute Resolutions
  • Develop and implement litigation expense control methods
  • Monitor all open lawsuits and ensure each has an Action Plan
  • Provide regular status updates to reinsurers
  • Monitor evolving case law and trends
  • Participate in Claim Reviews with Large Accounts and/or Program Partners
  • Perform other duties or special projects as required or assigned

  • Thorough knowledge of claims operations to include adjusting, LAE, customer experience, salvage, subrogation, and payment processes
  • Ability to create a positive work environment in a call center setting

QUALIFICATIONS:

  • Minimum 7-10 years claims experience
  • Extensive knowledge and understanding of litigation process
  • Effective communicator through written, oral, and electronic formats with ability to convey complex concepts clearly to a variety of audiences
  • Exhibits strong interpersonal skills including ability to develop consensus among decision makers
  • Demonstrates ethical work manner in dealing with confidential information
  • Adjuster license in required states preferred
  • Valid driver’s license

PHYSICAL DEMANDS:

  • Position operates in a professional office environment and routinely uses standard office and mobile equipment such as computers, phones, and photocopiers
  • Position may require traveling to agent offices, attending both internal and external meetings, attending conferences and other training events
  • Flexibility in daily work times and telecommuting is allowed; average 40-hour week; occasional evening, weekend work, or overnight travel may be required as job duties demand
